These Terms & Conditions (“Terms”) govern your access to and use of www.aceofheartsla.com (the “Site”) and all related products, services, content, and communications operated under the brand name Ace of Hearts LA (“Company,” “we,” “us,” or “our”). By accessing the Site, placing an order, or affirmatively agreeing to these Terms at checkout, you enter into a legally binding agreement with the Company. If you do not agree, you may not use the Site.
Eligibility
You must be at least 18 years old or the legal age of majority in your jurisdiction to use this Site. By using the Site, you represent and warrant that you have the legal capacity to enter into this agreement.
Intellectual Property
All content on this Site, including but not limited to logos, wordmarks, product designs, artwork, typography, campaign imagery, videos, photography, graphics, layout, text, and brand identity elements, is the exclusive property of Ace of Hearts LA and is protected under United States copyright, trademark, and intellectual property laws. Unauthorized reproduction, duplication, distribution, resale, modification, scraping, data mining, AI training use, derivative works, or commercial exploitation is strictly prohibited. The Company reserves the right to pursue statutory damages, injunctive relief, attorneys’ fees, and all remedies available under applicable law.
Limited License
We grant a limited, revocable, non-exclusive, non-transferable license to access and use the Site solely for personal, non-commercial purposes. This license may be terminated at any time without notice.
Product Availability
All products are released in limited quantities. No restocks are guaranteed. We reserve the right to modify pricing, availability, product descriptions, or discontinue products at any time without notice.
Orders & Cancellation
We reserve the right, at our sole discretion, to cancel or refuse any order, including but not limited to situations involving pricing errors, inventory discrepancies, suspected fraud, or abusive purchasing behavior. If payment has been processed for a canceled order, a refund will be issued.
All Sales Final
All sales are final unless explicitly stated otherwise on the applicable product page. Remedies, if any, are granted at the sole discretion of the Company.
Risk of Loss
Risk of loss transfers to the customer upon delivery to the carrier. Ace of Hearts LA is not responsible for carrier delays, customs delays, weather disruptions, or packages marked delivered.
Disclaimer of Warranties
THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACE OF HEARTS LA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO USE OF THE SITE OR PRODUCTS. TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
Indemnification
You agree to indemnify, defend, and hold harmless Ace of Hearts LA and its affiliates from and against any claims, liabilities, damages, costs, and expenses (including attorneys’ fees) arising from your misuse of the Site, violation of these Terms, violation of law, or infringement of third-party rights.
Arbitration & Class Action Waiver
Any dispute arising from these Terms or use of the Site shall be resolved exclusively through binding arbitration in Los Angeles, California. You waive the right to a jury trial and waive participation in any class action, collective action, or representative proceeding. Claims must be brought individually.
Governing Law
These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.
Modifications
We reserve the right to update these Terms at any time. Continued use of the Site constitutes acceptance of revised Terms.
